PUBLIC QUESTION TIME
Question: Anne Hamilton, 6a Carlyle Street Croydon 3136
“M/2017/544 - 2 Bond Court Croydon 3136. Why has the endorse tree management plan revised 8 February 2021 not been followed and adhered to. I have 9 trees on the norther boundary close to the fence. 3 are much taller than my 2 storey house with spreading canopies. At no time since the development was started and since all my phone calls, emails starting in April 2021 has any tree protection fencing been installed to protect these trees. Other tree protection fencing on the site have been installed moved and put back again but nothing to protect my trees. I fear for their viability and cannot take any responsibility for their failure.”

Since late February this year Council Officers have regularly inspected the development at 2 Bond Court Croydon both proactively, and also reactively in response to concerns from the author.
In late March Council also wrote to the owner of 2 Bond Court to formally remind them of their planning permit obligations to protect the trees on the site, including through the installation of tree protection fencing.
Two inspections of the property in mid-May found that the land owner had not erected the required tree protection fencing, and that they had commenced earth works. As a consequence a Planning Infringement Notice including a fine of $1,652 was issued to the owner on 21 May 2021. This Notice also required that the tree protection fencing be installed.
Subsequent inspections in June and July found that some, but not all, of the fencing had been installed. As the earth works were not in proximity of the trees referred to in the correspondence, they and the other trees on the site remain in good condition with no apparent impact. The landowner is in the process of installing the remaining fencing, and they have been reminded that should any works occur in the tree protection zones Council will not hesitate to take further action, including through additional infringements or action in the Magistrates Court.
