PUBLIC QUESTION TIME

Question: Representative from Jubilee Park Residents’ Group

“Maroondah recently undertook community consultation for the review of the Ringwood Metropolitan Activity Centre (MAC).  A key proposed change was to widen the boundary of the activity centre across Station Street to incorporate the land of the Ringwood Uniting Church, which is currently zoned General Residential Zone, falls outside the bounds of the MAC and was recommended for heritage-listing in the Maroondah Heritage Study 2003.  However, Clause 22.6-6 of the planning scheme also shows that this land has been designated a “Residential Development Area”, the purpose of which is to encourage high-density apartment development. Given this inconsistency, can Council please explain how this land came to be designated “Residential Development Area”, including whether the community was consulted about this significant change in the planned use of this land?  Further was a recent heritage assessment conducted of the church PRIOR to the land being designated as a ‘Residential Development Area’?”

In respect to the area south of Station Street, Maroondah Planning Scheme Amendment C16 introduced three residential precincts adjacent to the Ringwood Activity Centre.  One of those precincts was identified as lots fronting the south side of Station Street, Ringwood. 

This amendment was approved by the Minister for Planning and came into effect on 13 November 2003.  The amendment was prepared in accordance with the Planning and Environment Act 1987.  The amendment was exhibited and a Planning Panel was held to hear the submissions received. Amendment C16 was developed at the same time work was being conducted on Stage 2 of the Maroondah Heritage Study which was also finalised in 2003.The Ringwood Transit City Masterplan was approved in 2004 and also had a number of recommendations for this precinct in respect to zoning, built form and heights. 

Council has now commenced a review of the Ringwood Masterplan and a variety of different documents have been on display.  These documents, in respect to the boundary have been indicative only.  A revised boundary has not yet been considered by Council at this stage.

It is anticipated that the background work will soon be completed, and preparation of an Issues and Opportunities Paper will be presented to Council for consideration.  Community engagement is an important component in the development of the revised Masterplan and there will be further opportunity for community engagement.”

A proposal from our organisation was tabled at Council on 16 May 2016.  We want a reply regarding Council’s response to our proposal and what, if any, action has been taken by Council.”

“Council does not presently own or manage the Croydon South Primary School site and is therefore unable to consider any formal proposal for the future of the land at this time.

Council has been working closely with the Department of Education to finalise the ownership of the land and has entered into a formal exchange of land agreement to facilitate the land transfer.  It is expected that the formal transfer of land to Council’s ownership will be finalised by the end of the year.  I also note that Council has not finalised the extent of the area of land that will be transferred to Council’s ownership. Council has allocated $60K within its 2016/17 operational budget for the development of a master plan for the site.  The master plan process will commence when Council has finalised the transfer of land. The master plan process for the site will commence in early 2017 and involve significant community consultation including engaging with the Maroondah community to determine their needs and view of what is an appropriate use of the site. The proposal submitted by U3A for a community facility on the current school site will be considered as part of the master plan process. A formal response will be provided to U3A’s question.”

Protecting the Health and Welfare of Council Authorised Enforcement Officers                                                                                                                                            ITEM 2

That Council advocate to the State Government that for the purpose of protecting the health and welfare of Council authorised enforcement officers, there is an urgent need to amend and insert in the Local Government Act 1989 the following:

1.       A specific offence provision(s) within the Act that applies to causing serious injury or the death of a council appointed authorised officer. Specifically, the offence(s):

i.        To reflect the current offences to which section 10AA of the Sentencing Act applies, such as:

-      Intentionally causing serious injury or the death of an authorised officer performing their duties, in circumstances of gross violence

-      Recklessly causing serious injury or the death of an authorised officer performing their duties, in circumstances of gross violence

-      Intentionally causing serious injury or the death of an authorised officer performing their duties

-      Recklessly causing serious injury or the death of an authorised officer performing their duties

ii.       The penalty for the offence(s) to be a significant fine or imprisonment, or both

iii.      The offence provision to include a subsection that makes it clear that it has effect in addition to, and not in derogation from, any Act or law relating to civil or criminal liability. This will ensure that the offence provision will not limit other criminal and civil proceedings that may be brought

2.         a definition of ‘serious injury’ that refers to the definition currently contained within section 15 the Crimes Act

3.       That upon conviction, Local Governments have a capacity to recover all costs associated with the incident including additional work cover premiums from the defendant
