PUBLIC QUESTION TIME

Question: Mr Ian Ashman, Croydon (represented at meeting by Mr Peter & Mrs Jill Garbett “Can Council please provide an update on progress in the matter of the proposed moratorium on multi-unit developments in the Ruskin Park area?  Has any feedback been received from the Planning Minister, Richard Wynne?

I would also like to thank Maroondah City Council for supporting Ruskin Park residents in this matter.  It means a lot!”

 

Response: Phil Turner – Director City Development

“Council officers and the Mayor met with the Planning Minister, the Honorable Richard Wynne on the 25 February 2016.  At that meeting there were a number of issues discussed including the issue of multi unit developments in the Ruskin Park area.

The presentation from Council appeared to be well received by the Minister and his Advisors. Council has since received a letter from the Minister advising that he will not consider a moratorium. However at the same meeting the Minister requested some more specific proposals on a way forward and discussed the proposed Maroondah Housing Strategy, the draft of which will be also considered for public exhibition by Council tonight.  Another meeting has been arranged with the Minister on the 28 April and Council will now discuss the options coming out of the draft Maroondah Housing Strategy.”

 

Question: Ms Anne Anderson, Bayswater North – “Does the Council believe it is appropriate to continue to fund and endorse Glen Park Community Centre while it rejects without reason membership renewals from local residents, in breach of the Associations Incorporation Reform Regulations 2012?”

“Council is in discussions with the Glen Park Community Centre Committee of Management in respect to issues of governance and process. Council will take up the issue of local resident membership renewals as part of these discussions.”

 

Question: Ms Amber-lea Drinnan, Bayswater North – “Council has a large portfolio of publicly owned buildings in which they own and oversee. These buildings are either used directly by Council services, or they are leased or subject to a deed of delegation. What responsibilities do community organisations occupying Council buildings have to report to council? And how does Council monitor adherence to the 6 principles, specifically, item 6 where community groups must demonstrate direct benefit to Maroondah residents?”

Response: Phil Turner – Director City Development

“Council has a significant portfolio of buildings that are leased / licensed to community organisations for community purposes.  If the property is leased, the reporting obligations of particular organisations are subject to a Community Facility Lease entered into between Council and the relevant party.  Each lease is structured to accommodate the particulars of a range of organisations.  Council is aided by a Community Facilities Occupancy Policy that guides Council in the initial consideration and allocation of Council facilities.  This Policy sets out 6 principles to guide Council's decision making under the following headings: 1/ Appropriate,  2/ Transparent,  3/  Fair and Equitable,  4/ Promote Participation,  5/ Maximise Usage,   6 Local Priority.  Each lease incorporates a number of tenant reporting obligations. In addition, Council proactively inspects each community facility every three years.  This involves senior officers speaking to representatives at each facility as part of Council’s detailed facility planning framework.  These discussions provide an additional reporting conduit and inform Council’s infrastructure renewal approach moving forwards.”

That COUNCIL ACTING UNDER section 189 and CLAUSE 3 OF SCHEDULE 10 TO THE LOCAL GOVERNMENT ACT 1989 (‘THE ACT’) resolves that:

1.       THE STATUTORY PROCEDURES BE COMMENCED TO DISCONTINUE for the discontinuance and sale of part road at the northern end of windsor road, croydon and sale of a previously discontinued road, lot 1 on plan of subdivision 23714, as depicted in attachments 1 & 2 of this report

2.       PUBLIC NOTICE BE GIVEN IN ACCORDANCE WITH SECTIONS 189, 207A AND 223 OF THE ACT AND WITH COUNCIL POLICY; such notice to state that council proposes to sell the land to ventura bus lines for market value;

3.       IN ACCORDANCE WITH SECTION 223 OF THE ACT:

i.        A COMMITTEE COMPRISING COUNCILLORS FITZGERALD, STEANE AND WILLMOTT be appointed TO HEAR ANY PERSON WISHING TO BE HEARD IN SUPPORT OF THEIR SUBMISSION, ON A DATE TO BE DETERMINED;

THAT COUNCIL ENDORSES THE ACTIONS OF OFFICERS IN

 

1.   SUBMITTING THE FOLLOWING 4 MOTIONS ON BEHALF OF MAROONDAH CITY COUNCIL FOR CONSIDERATION AND DEBATE AT THE MUNICIPAL ASSOCIATION OF VICTORIA STATE COUNCIL MEETING:

 

i.        ELECTORAL VOTING SYSTEM – MORE THAN ONE VACANCY

Motion:- THAT THE MUNICIPAL ASSOCIATION OF VICTORIA STATE COUNCIL CALLS UPON THE STATE GOVERNMENT TO REQUEST THE VICTORIAN ELECTORAL COMMISSION TO REPORT ON THE FEASIBILITY OF IMPLEMENTING AN OPTIONAL PREFERENTIAL SYSTEM BASED ON SENATE REFORMS FOR ELECTIONS WITH MORE THAN ONE VACANCY.

 

ii.       CASH IN LIEU OF CARPARKING PROVISION FOR PLANNING SCHEMES

Motion:- THAT THE MUNICIPAL ASSOCIATION OF VICTORIA STATE COUNCIL CALLS ON THE STATE GOVERNMENT TO. AMEND THE PLANNING AND ENVIRONMENT ACT 1987 TO INTRODUCE A QUICK AND SIMPLE "OFF THE SHELF" CASH IN LIEU OF CARPARKING PROVISION FOR PLANNING SCHEMES TO ADDRESS THE LONG TERM PROBLEMS OF DEVELOPMENTS WHERE ADEQUATE CAR PARKING CANNOT BE PROVIDED ONSITE.

 

iii.      RAILWAY STATION CARPARKING

Motion:- THAT THE MUNICIPAL ASSOCIATION OF VICTORIA STATE COUNCIL CALLS UPON THE STATE GOVERNMENT TO RECOGNISE THAT PARKING PRESSURES FROM RAIL STATIONS EXTEND BEYOND RAIL PARKING FACILITIES AND IMPACT UPON LAND USE PERIPHERAL TO STATIONS, WHICH IN TURN IMPACTS UPON LOCALISED PARKING ISSUES, AND THAT IN RESPONSE STATE GOVERNMENT:

A.      PROVIDES ADDITIONAL OR BETTER PARKING INFRASTRUCTURE AT STATIONS; AND

B.      CONSIDERS A STRATEGIC APPROACH TO LAND USE AROUND STATIONS THAT:

·        IMPROVES MULTI MODAL INTEGRATION AND TRAVEL DEMAND MANAGEMENT; AND

·        ENCOURAGES WALKING AND CYCLING FOR RAIL PATRONS WITHIN 2KM FROM A STATION

 

 

 

 

 

iv.      COST OF LOCAL GOVERNMENT ELECTIONS

Motion:- THAT THE MUNICIPAL ASSOCIATION OF VICTORIA STATE COUNCIL SEEKS AN ASSURANCE FROM THE PREMIER THAT IN RELATION TO THE CONDUCT OF LOCAL GOVERNMENT ELECTIONS:-

A.  THE VICTORIAN ELECTORAL COMMISSION (VEC) COSTS BE RESTRICTED TO INCREASES EQUATING TO RISES IN CPI; AND

B.  THE SOLE MONOPOLY OF THE VEC FOR ELECTION SERVICES BE PUT ASIDE TO PERMIT COMPETITION IN THE INTERESTS OF COMPETITIVE COSTING.

 

2.   INDICATING THE SUPPORT OF MAROONDAH TO THE 4 MOTIONS CIRCULATED BY MANNINGHAM CITY COUNCIL, NAMELY:
